I've been trying to get SD since '06. I have good well documented claim including a back injury and a recent PTSD diagnosis that causes agoraphobia, depression, etc. I'm on multiple meds that cause side effects. Last year I signed with a non lawyer rep, and they've gotten nowhere. I can do THATS myself. Can I drop them without being charged for the year they've gotten me no results?
Answer
Usually the contract must be filed with the Administration and approved before the non-attorney Rep may charge a fee. So generally the answer is you may discharge the Rep whenever you wish, but there is a trap.
Some reps charge an outrageous "File Maintenance" fee on a monthly basis. If they are discharged some may request payment of that in lieu of a fee. State Bar regulates attorneys but not non-attorney reps. SSA has their own office but it is hard to find the address to complain.
