I signed a flat rate agreement with an attorney. I terminated her and hired a new attorney because I wasnt happy with how the case was handled. The agreement says that if terminated early, accounting of hours is at her hourly rate. She tells me that she is going to bill me for her hours at the hourly rate because that exceeds the flat rate agreement. Can she bill me more than the flat rate because I terminated her?

You said you have a new lawyer - talk to that lawyer about what is happening with the old lawyer. The agreement at issue is material in understanding what has happened.
