Is it illegal to withhold a paycheck
Answer
Sure is! Assuming no other facts or agreements, the general rule is stated in the Labor Code that the employer has 72 hours to make payment for all sums properly owed to the employee. If you were fired or if you quit, it doesn't matter, and the employer has held your check and you haven't been hiding, well you have a claim for the money owed, plus penalties, and attorneys fees and costs.
