Question

Do you know how Tony Robbins, Peak Potentials, and many others who do workshops/classes/events all over the USA are legally registered? I was recently speaking to someone and they said you have to register in every state you do events. Is this true? I can't imagine these people are registered all over the place or is this a risk that one takes? Maybe there's a special way of setting up one's business if you do events in many different states? Or a special release to have participants sign to protect yourself? Thank you.

Answer

If you maintain a consistent presence (address, boots on the ground, employees or ICs, showroom, warehouse, etc.) in all these different states, then you should qualify your entity to do business there. For example, we have a client in the real estate education space that holds seminars around the country and he is qualified in I think 38 of the 50 states. This is quite common.

Now if you are only going to be there once in a while or just a one-off program I would not worry about it. But there are other considerations that might force registration. For example, the venue might demand that your entity carry insurance for your engagement. No problem, but the insurer might require that the entity then be properly registered in the state where the venue is taking place.

The following offer a brief overview of foreign qualification that might be helpful:

Question

Why visiting a hospital in ga in april 2010 i slipped and fell on a floor that was being waxed. a security guard took me and my family members down a hall that was being waxed and i slipped and i hurt my knee and my back. i'm still in pain from these injuries, can i sue for my injuries?

Answer

It sounds like you do have a valid case. It can be either against the hospital if their staff was waxing the floor or an independent contractor if the hospital hired an outside company to clean the floors. I can handle the case pre-suit for you since most cases settle or you can contact a Georgia attorney.

Answer

Yes. I assume the accident was reported and you have documentation of your medical condition.

Answer

Based on the information given, you may have a case against the hospital for premises liability. As a result, the hospital would be responsible for properly compensating you for any personal injuries that you may have as a result of your fall on the waxed floors. Additional information is needed to fully assess your case- however, do not post the specifics on this public website.

I am licensed in Georgia and Florida, so please feel free to call my office this afternoon for a free consultation and information. (404.496.4119)

Good luck.

Question

A family member is contesting the petition of conservatorship of another member and the dipsute is regarding a disabled sister. The objecting member made false and malicious allegations about the proposed conservator and his spouse. Can the spouse who is not involved, nor named in any peititons of guardianship or conservatorship, have the right to sue the objecting party for slander? Many false and derogatory statements were made against the proposed conservator and the spouse all of which were documented by the probate investigator .

Answer

You can't sue for defamatory statements related to court proceedings (such as in court papers, statements made to the police, or to the conservatorship investigator). If they repeat the allegations to third parties in a manner that isn't connected with the court proceedings, that's another story; even then, you'd have to pay for a lawyer, and you'd have to prove damages.

Answer

Mr. Stone is correct, particularly on the issue of damages if there was any defamation outside of court proceedings. You have to show specific monetary damages.

Question

My boyfriend received a "Social Host" misdemeanor charge and he is due in court within the next 10 days. What should he expect? He is not the owner of the house, and there are also 5 other renters who live there who were all present at the party, but he was the only one to get the ticket.

Answer

None of that negates the charges against him. He must have done something very offensive to the arresting officers for him to charged with a crime. He needs to see if he can get a public defender and get the charge reduced to an infraction that will be dismissed after a certain period of time. He should not plead guilty. But why is he not asking the question himself and waiting until until less than two weeks for his initial appearance? He does not appear to be taking this very seriously.
