Otherwise, if everything you are saying is occurring with the drug use, you have a good chance of custody. P.S. No. He should not be taking your daughter away in the meantime and when you seek counsel it should have no effect on your chances of custody. You will have to prove his drug use for FULL custody and might even obtain a ruling where he has very limited if any visitation rights if he is using drugs and the judge determines it is in the best interest of the law to keep the child away from him until he cleans his drug use up.

A court order is a court order, if you and your attorney think its BS - appeal. Otherwise, either pay up or be prepared to pay the consequences' for failing to comply with the court's order. And BTW if this is a Virginia order - you need to ask your question to Virginia attorneys - their laws may be different.

If I take a person to small claims court and win, if I go to garnish her wages, if she quits, or is fired, can I take the balance that hasn't been paid and follow her to her new job and garnish those wages? Or is it, a one time thing? I read, if she files for Bankruptcy, then that would be it, I couldn't garnish her wages from future jobs. So was wondering if she just quits or the employer fires her or makes it look like they fired her and actually transfers her to a different company in this large corporation, would that be it, or can I just follow her to new job? Would it be best to put a lien on her house instead, if this is a one time garnishment thing?
