I am selling my business. A company signed our confidentiality agreement and viewed all our private information only to purchase a competing business with similar products.
I believe they had no intention of buying our business and only wanted a competitive edge. Is their a legal remedy for this?
Answer
That would depend on how good your confidentiality agreement was.
Answer
Very likely not. If you have some reason to believe that they sought to exploit information or trade secrets beyond what you described here that will have to manifest before any action could be taken. The fact that they purchased another business actually supports their position, that is that they were in fact and in good faith seeking to buy a business. As of now, you would have no complaint nor any damages for a legal claim.
I would urge you to consult a lawyer in private of course if there is more to this story that causes you concern.
If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.
Our firm is now referred by the American Bar Association (see under the New York section):
