Question

I went to court today and hd another horrible experience with this one judge. I am in state of PA. I want to have him removed and am not sure if I can or how to do this 19073

Answer

Hi, Thank you for your question,

If a litigant believes that the Judge hearing their case is biased against them, they can file a "Motion to Recuse", asking that the Judge "Recuse" himself and that another Judge replace him (or her). This is not easy, but it can be done. The litigant requesting the Judge's recusal must have concrete examples of the Judge's bias and cannot make this request simply because they think the Judge is giving them a hard time, or because the Judge is not ruling in their favor. You should also keep in mind that the Motion will be heard and decided by the Judge who is already assigned to the case.
