Question

I own a house and I have rented it, I need the house now from the renter, My family in geting larger and i need to move my son and daughter into the house. can it be done?

Answer

The easy answer to your question is yes, it can be done. How it is properly done will depend on the details of the situation. A notice will have to be served on the tenant and if they do notvoluntarily vacate at that point a summary proceeding for the tenant's eviction will need to be filed in the Housing Court. As New York State law is very specific as to the exact wording required in these Notices and the manner in which they must be served upon the tenant, it is highly advisable to retain the services of an attorney experienced in these areas. A small mistake can set you back months in the process. We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination.
