Question

Hello, I am chemist by profession and when I joined my previous company I signed none compete agreement for five years with them which says I can not work in any generic company involved in similar product manufacturing for next 5 years after I resigned from my current job. Now in January I changed my job which was nearby my home and better pay. My past company sent legal notice from lawyer to my current company and due to that I lost my job. I asked my current company to provide me copy of document but they didn't respond to my email and calls.

I have no job and any earning source. Please guide me.

Answer

I think a 5 year duration on your non-compete in NJ would not be enforced. NJ courts tend not to enforce beyond 2-3 years. But if the agreement is otherwise reasonable it can likely be enforced. What is the geo-graphic restriction?

I would discuss it over with a lawyer in private to see about your options. If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.

Our firm is now referred by the American Bar Association (see under the New York section):
