I had an order to answer back in January, which I did attend but there was only their attorney to talk with. The result was that I have a garnishment on my wages in place that calculates payment of the judgement amount. The rest of my check is direct deposited into my checking account. Now, I have received my income tax returns direct deposited into my bank account last month but when I went to bank my account is been put on hold and and overdrafted because they say they received something from deptor. In mail that day came an order on proceedings supplemental with interrogatories with no further court date given(stricken through date and time). Is this document legal for the bank to use to hold my funds even with the judgement being already entered for wage garnishment? How can debtor go over the amount calculated and take all of savings and checking funds which include same wages?
Answer
Without seeing the papers, it is difficult to answer your question. However, if your account balance increased, the amount of the garnishment may increase as well. If you question the validity and accuracy of the garnishment, take it to an attorney for consultation
