Question

I have been commanded to appear as a witness for an I.R.S. Criminal Investigation of a former customer of mine, before a U.S. District Court Grand Jury in ANCHORAGE , ALASKA... and I live in Florida. Can they force be to travel that distance? Doesn't FRCP Rule 45 prevent me from having to travel more than 100 miles (and never out-of-state) as a witness?



Answer

The feds could require you to appear, however, it would have to be at their expense. Usually they will allow a telephonic appearance, but it is up to whomever issued the subpoena.
