I am receiving a new job and under it they require a background check. Over the summer I was arrested for retail theft for 28$. I met with my magistrate and figured everything out as well as paid my fine. He said it was a summary offense. Will this be a problem for my new background check? The check I believe discusses any felony or any two misdeameanors.

Answered by Michael Kotik lawyer at www.legalphilly.com Well a summary offense is not a felony or a misdemeanor. I have seen situations where employers do not care about a summary offense, and other situations where they make a big deal about it. I guess it all depends on the job, and your employer. I would perhaps consider disclosing to your employer. That level of honesty might win them over.
