Home in Florida willed to two brothers. One wants to sell, the other doesn't. How can this be resolved?



Answer

If the brother who doesn't want to sell can't or won't buy out the other, and the 2 can't agree on selling, then the court can be asked to rule on a "Partition Action" which will force the sale. This action tends to result in reduced sale prices because the public is aware of the court order to sell.
