was divorced from a military man and i received 50 percent of his retirement the formula that suppose to be used isn't. The 50 percent is correct but the years married is in years not months so I have to clarify the order....i think that's what it is called. I didn't have a lawyer for my divorce he did. Does my ex husband need to be present to clarify the order because we have no contact and two can he fight me so i don't get that 50 since i remarried and win even though it was in our divorce agreement and Nowhere Does it say if i remarry I lose it
Answer
He would need to be notified if you motioned to clarify the order. It would be advisable to have an attorney experienced with military pensions and the formula typically used to review the document with you.
