Question

I was stopped by sheriff deputies for driving to slow. They said they smelled marijuana and I told them to search the car I don't have anything and I do not smoke. I had bought the car 8 days earlier and it needed some repairs and I parked it at a friends and I had been riding my motorcycle. I drove it home the night that this happened. The cops went all through the front found nothing and then opened the back passenger door said there it is and picked up what they say was a piece of a bud value 1.00. In the police report they wrote that they stopped me for doing 25 in a 55 for my welfare. That they found that bud and that I had weed dust on my shirt. and that I had admitted smoking earlier that day all lies. Can I ask for the stop to be suppressed for illegal stop? And, they never even shined a light on me to see any weed dust.

Answer

Yes you might have a motion to suppress there. You need to sit down with an experienced attorney who can use their experience to advise what kind of motion would be best for your facts.
