Hello. I reported my homeowners subdivision association to the EPA for seriously breaking water laws. I was contacted by the EPA that they had forwarded my complaint to the government agency in New Mexico that handles water. Now the association is suing me. I have emailed the EPA contacts and New Mexico person that referred me to, repeatedly asking for Whistleblower protection , and have gotten zero response. How do you suggest I proceed?
Answer
Find an attorney in your town who has experience with environmental issues. Referrals from friends are best, from relatives next. You can also find one @ http://www.nmbar.org. When one is sued in NM there is a 30 day answer period. Let that go by, and you will be in default and a judgment may be directed against you. Most lawyers will consult initially at no cost (ask) so you can find out what's involved and costs. You cannot adequately protect yourself by asking free questions on this board. Taking your post at face value, an experienced attorney may be able to get you compensation for several things. Don't delay if you have a lawsuit pending against you. Time is running out.
