Question

I am divorced but we still have community credit card debt. My ex is being sued for a $2,800 unpaid credit card that she used for company. On the filing with Louisiana secretary of state I am not part of her company. Does this fall into community debt and do I owe half?

Answer

Any debt incurred during the marriage is PRESUMED to be community. It would be your burden to prove that it was not community debt. You certainly have an argument for it, but you have an uphill climb.
