I work part-time, only 4.5 hours each day, Monday through Friday. I work for an Adult Day program. My employer sent us home about an hour early on December 24th and December 31, 2014. Otherwise, my hours should have been 11 x 4.5 at $20 per hour $990. However, I was just informed by the owner of company that she deducted a total of 4.5hrs (or $900 gross) due to let us off on the 24th & the 31st. I told her that other employees had not been deducted the 4.5hrs. Her response was to say, she would deduct their paychecks when she got back! I need to know if any of this legal? I reside in Southern CA. Thank you in advance for your response.



Answer

She is not allowed to deduct 4.5 hours for letting you off early only one hour on two days. She can only deduct 2 hours total for that, or whatever time you were actually let off early. An employer is not obligated to give you any particular amount of hours. They are legally free to send you home early, but they must pay you for the actual hours worked, whatever that is.
