Several years ago, my husband built a fence across the back of our property, extending a part onto neighboring property. This year, he is replacing the fence because of weather damage, which meant he had to take down the fence on the neighboring property, because it was a part of our fence. The owner of the neighboring property is yelling at him to replace it because when he put it up, it became her property. I would like to know if he is legally responsible to replace about 3 feet of fence for her?



Answer

It was not a gift. No reason to replace.
