In Illinois, during a courtroom proceeding open to the public with no court reporter present, was it ever legal to disable the automatic recording equipment to eliminate any electronic record of what was said?



Answer

The judge almost certainly has the discretion to conduct proceedings without the recording system in operation, though I can't think of a good reason to do so if the equipment and personnel are readily available. The party wishing a record of those proceedings must object to conducting the proceedings that way, can hire a court reporter to record those proceeding, and has other rights.
