Question

Is a drug test required before a court hearing on an unrelated offense? Also what is your opinion on what my punishment will be for a gross misdemeanor money fraud (counterfeit 100$ bill) and I am only 15, and I truly didn't think I would get in any trouble.

Answer

The court has wide discretion in determining any bail conditions. The Judge may decide that a drug test is necessary as part of the bail conditions.

A charge of counterfeiting currency is generally a felony charge under Minnesota Statute 609.632. It sounds like the State is acknowledging that this might be a unique case. Because of that, I would strongly advise you to gather all of the paperwork that you have regarding this case and meet with a criminal defense attorney. Many defense attorney's offer free consultations that will help you understand the charges, your options, and your rights.

Answer

It is never "required." However, a court may set conditions of release and, as part of those conditions, it may require a drug test as part of any hearing or pending a hearing.
