Question

Our son who is 20 lives in our basement. A girl moved in with him until she could get a job and get on her feet. Or so this is what we were told. After she lied to us numerous times we made her move out. She has left clothing, personal items, and furniture pieces here and we would like her to get them. She has not. Please tell us how we go about getting these items legally gone. We want to do this the correct way.

Answer

Was this last week or a year ago? What have you done to try to get her to pick them up? Do you know where she lives? Get your son to box her things up and take them to her, or you can do it. Since it looks like you "made her move out" without following the proper legal procedures for evicting residents it is a bad idea to toss them, if that is what you were thinking. Box them up and keep them in the basement until she comes and gets them.

Answer

It sounds like you already broke the law and did an illegal eviction, since you did not mention giving her the required 60 day notice. Given that you could be sued for that, don't compund the problem. Store her stuff forever, since with the illegal eviction you have no right to do anything to the property. (And you might get your son to grow up, talk to her, rent a Uhaul, and make arrangements to bring her the stuff, if you don't want it there a long time).
