I have just found out that my husband of 1 month was in a common law marriage. They haven't been apart for even a year. I need to know if my marriage is valid.
Answer
If the common law marriage was proven valid in court and he was not divorced, your marriage is void until the common law marriage is ended.
If the common law marriage is not proven in court, your marriage is valid until it is, which may be difficult to do in view of your marriage. Suggest you consult a family law attorney in your area.
Answer
I agree with Keith, but also ask how do you know it was an informal marriage? There is a three-prong test to prove it was an informal marriage. Did they file a declaration with the County Clerk? You might be fine, legally. A consultation with a local attorney to review your specific facts might answer many of your questions.
