My husband and I are still married. We live in Michigan. Can I take our son out of state to Florida without his permission? We are on the verge of divorce and I'd like to move closer to my family.

There is no court order so you are no prevented from leaving with your child. However, you husband may file in Michigan and get an order preventing moving your child out of a 100 mile radius. Then you'll have to appear before the court and request modification of that provision. The court may or may not grant your request so don't get too comfortable in Florida.
