Question

Under the lemon law can I get back the the car I traded, and void the deal? I haven't had the car 30 days and check engine light came on and it is driving terribly. When I took it to an auto store they put it on a computer said it registered 3 different cylinder misfires. They told me not to drive it anymore than necessary or there could be permanent engine damage. I am going to speak with the dealer today and wanted to know my rights. This is a used car (2011). It does have a limited warranty. Thank you!

Answer

Lemon law does not apply to used car transactions. In NC a used car is an "as is" purchase unless you received a warranty. You need to look at the warranty to see if the issue is covered, or not. Even if it is covered, the warranty will not allow you to back out of the transaction completely and void the deal. It is too late for that.
