If you are a salaried employee and the pay date is the 15th of the month, but your employer pays at a different time each month is it legal for them to wait 5 or 6 weeks to pay you?



Answer

It is not a "crime" if that is what you are asking. The bigger issue is that the failure to pay employees is a huge red flag that the company is having serious money problems. That could lead to closure or layoffs. You would be wise to start looking for another job. You can then pursue any claim for salary. You can certainly push it now on your own, with a lawyer or with the help of the GA Dept. of Labor, but if there are layoffs they may choose to get rid of the loudest people. Unfortunately, you might be in a no-win situation for now.
