My husband and I bought a house last year. The deed is in both of our names, but the loan is only in his. Does this give him more legal right to the home if we should seperate?



Answer

No. If the house was purchased and paid for during the marriage, it does not matter whose name the loan is listed. It may make a difference if both of you want to keep the house, depending on your financial ability to refinance the loan to remove his name from it, but it will not affect whether you have as much entitlement to the equity in the home as he does.
