Question

what happens if a couple gets married in NJ, but the groom is still married in PA? I know someone who's divorce is not finalized, yet is getting married in NJ. I think he lied and stated he was never married before.

I know his soon to be ex wife never got a copy of any divorce decree, and in fact still has yet to pay her lawyer for the filing fee? Is this a crime?

Answer

Yes, it's bigamy. Also grounds to annul your marriage.

John

Answer

The husband committed bigamy by marrying a second time before his divorce was final. Without a divorce decree, the would be groom had a legal impediment that prevented him from entering into the second marriage. However, by attempting to enter a second marriage before his first marriage was dissolved, he committed the crime of bigamy.
