DHS has taken my children for unwarranted reasons. Do I continue cooperating with them fully, which is what I have been doing, or do I need to seek legal help? It is not in the courts (yet) and I want to believe that this will come out okay seeing as how I do not abuse my kids but I am terrified as are my children. I know that lawyers say LAWYER up! but I want to know the truth--will cooperating fully with both the police and DHS help me or hinder me?
Answer
You are entitled to a court appointed attorney if your children have been removed so if you have not done so you should fill out the affidavit and make application to the court. A lot depends on what the children were removed for, whether there are drugs or alcohol involved or an unfit person in the home. If you do as you are asked to do the process will run itself in about eight months. If you decide you've just got to go and get into a fight with DHS and not do as they ask or cooperate with the court, the outcome is much less certain. This is a fight that people rarely win, and almost never on appeal.
