Question

My ex is ordered to pay me alimony for another 9 years (papers also state it cannot be changed). I have been divorced for 15 years already. he is also ordered to pay child support for my sons till each is 24 years of age upon enrollment in college full time. (which they are) My problem is this. He quit his job of 20 years. Got a new one last year. and worked there for appx 2 months and was fired. He then decided he was going to school for a degree at 54 Years of age. For 26 weeks he recieved unemployment payments and he also gets VA disability benefits monthly. Now his unemployment has run out. And he contacted me to tell me there are no more funds for him to pay me. His VA disability benefits are minimal. so he wont be able to send me funds. Can he be ordered to stop this foolishness of going to school and get a job? or sell assets to cover his obligation? I am concerned if I take him to court on this that the judge will lower his obligation to myself and his children even though the mess he has himself in is of his own doing. Should I seek legal assistance? Or ? Thank you

Answer

If your ex has not returned to court to downward modify the existing support. The support continues at its present level. Please meet with an experienced family law attorney to explore your legal options.
