It takes people to process your ticket, these people have to be paid thus unless you are found not guilty, you somehow magically convince an ADA to dismiss your ticket or you convince a Judge to waive costs - one way or another - you are paying Court cost.

It is not a "crime" if that is what you are asking. The bigger issue is that the failure to pay employees is a huge red flag that the company is having serious money problems. That could lead to closure or layoffs. You would be wise to start looking for another job. You can then pursue any claim for salary. You can certainly push it now on your own, with a lawyer or with the help of the GA Dept. of Labor, but if there are layoffs they may choose to get rid of the loudest people. Unfortunately, you might be in a no-win situation for now.

Also keep in mind that using terms like "intimidated," "scared," "afraid of the big companies or firms" are also HUGE red flags for potential lawyers because 1) it is virtually always untrue, and 2) it almost always means that the potential lawyers have told the client they have no case and the client refuses to take the advice, or the client wants the lawyers to do something inappropriate or unwarranted.

You do need new counsel, and it is going to be hard to find one, not because Roy Barnes' firm is on the other side (which is NOT intimidating at all), but because you can't get along with your lawyers.

Other advantages use to be having workers for whatever sort of trade your family was involved in. Today advantages of early marriage are consummating your relationship (if you have not already), showing him/her you want to take it to the next level, and also being married brings in a whole new and challenging lifestyle. Basically the only thing I will say is don't take marriage to lightly, it takes two dedicated people to truly make it work and another thing to keep in mind is making a relationship work is a choice. Ask yourself are you ready to do whatever it takes to make your significant other feel happy, loved, and secure? If the answer is no to any of those questions give it some more time. Also talk about it with him/her, you might find they have some input as well. Keep in mind we do live in a material society and you will need money for the house/apartment, cars, food, bills, etc. Money can cause huge issues in a marriage so if you are not financially set, get to that point and then take a stab at marriage.

This is a question better addressed to your accountant or tax preparer. It strikes me that the matter is tied too directly to your individual situation to be addressed here.

In general, however, I would put my EIN instead of my SSN on anything having to do with the business. The EIN almost certainly should go on the W2's, with the name the IRS has associated with the EIN. The same is true if you have a number from EDD.

The bolt lock for my room has been broken for about 6 months now, and I have brought the problem to the attention of the housing coordinator and 2 of his student assistants, still nothing has been done.

I see nothing that would constitute a court case. You have not suffered any physical or monetary injury, and thus do not have any cognizable damages. You also have no ability to sue to force the repair of the locks.

If you have a contract that obligates them to maintain your door locks in good working order, and they have proper notice to fix it, but have failed to do so, you can get the lock repaired or changed and ask for reimbursement. A contract that is entered into at a time when the grantor/seller is incompetent can be set aside upon a court's finding of incompetence at the very instant of executing the deed. That's a pretty stiff burden. In order to prevail you would have to have an expert to testify that you were incompetent at the time the deed was signed. It's difficult for me to imagine a scenario where an expert would support that position simply because you may suffer from bipolar disorder.

If services were performed then you would owe on the bill whether you are retained as a client or the relationship is terminated. It may be the case that your attorney does not want to continue providing services because you are not paying your bills or the attorney expects you will not pay your bills into the future. I'd suggest talking to your attorney about what is going on.

My mom, thankfully, is very healthy, but recently asked my sister if something were to happen to her, what was she planning on doing with her house and life savings. There are 3 of us. My sister tells her that she would allow our nephew and girlfriend to reside in the house and use my her (my moms) life savings to pay for the house, taxes and whatnot... Then she claims, when that ran out, she would sell moms house and split it 4 ways, including our nephew! My mother said, absolutely not! He's not to be involved at all... My sister says, even if my mom were to draw up a Will, it would be moot, because all cash and house is in my sisters name only. Mom doesn't think!!! Our question is this: If my sister writes a letter, (We each get an original) notorizes it and confirms that the house indeed belongs to our mother and states what is to be done in the future, would that be legally binding and assure that my mothers wishes are carried out? My sister isn't fighting it, but mom wants to be certain that her wishes are carried out.

Unfortunately, putting the house and life savings in your sister's name was a transfer of assets by your mother. This has consequences beyond just where those assets go upon her death. If she needs medicaid and other government benefits within a certain time after the transfer, she would not be eligible to receive the benefits.

Unless your sister transfers everything back to your mother, your mother has no right to direct the disposition or to dispose of these assets. She could possibly go to court to sue for the return of legal title, but then she would have to disclose the personal reasons, which she probably did not want to do in the first place.

It is doubtful that a letter would work. Perhaps, if your sister transfers everything into an irrevocable trust that has all of the conditions governing what happens to the house and money that would take care of your mother's concerns. But there are many issues to be considered even in setting up such a trust.

I'm thinking about divorce. When I got married, my wife basically had no assets but she did work. Since marrying, we now have a child and she has stopped working. I own a home outright (which we live in today) as well as personal and IRA assets worth about $1M today (which were worth about $600k) when I got married. I never contributed or withdrew any money from my personal or IRA brokerage accounts during the marriage. Do I get to keep the home and brokerage accounts as separate property?

If you never made deposits to the brokerage accounts, they should be separate property. If the home was paid off before marriage, and you made no improvements (not maintenance, but improvements) during the marriage, it would probably be separate property too. If you had a mortgage and/or equity line on it when you married, that was paid off after marriage, then it will require a careful analysis of the financial facts to determine what interest the community might have in the house. You don't ask, but you also need to expect to pay spousal and child support. Depending on the totality of your family and personal finances, those assets are not likely to be, but could be, a factor in the support calculations.

If a consumer buys a product then tells a friend about it, the friend can rest assured that if they buy the same product they will have the same result. Services do not operate this way. The trust consumers have in a persons ability to execute the same level of customer service day in and day out is nonexistent and for good reason. People are inconsistent creatures and that's why service marketers are burdened with showing proof not once, but several times that their service will leave the customer happy.

Proof - this is the proof that your service or product is worthy of purchase. Products seldom need proof because they are tangible and returnable. Proof for services may include testimonials, photos, audio, video, sales vs return data, or other.

As you can see, marketing a start up service poses the chicken or egg problem. You will need proof to gain new customers but you cannot get proof until you have new customers. This brings us once again to being thankful that it costs little or nothing to provide a service. With a little wiggle room in your service budget you can afford to give some serious discounts to jump start your business.

Expect slower growth with a service but higher profits.

I am sorry to say that the simple answer is "no". A police officer can check your license plate status for no reason or any reason. License plates are considered to be open for public viewing and therefore generally not subject to an expectation of privacy. In fact, there's an appellate case with similar facts as yours (officer ran the person's license plate for no reason, or on a hunch). United States v. Diaz-Castaneda, 494 F.3d 1146, 1148 (9th Cir. 2007) ("We are presented with a question this court has not yet resolved: Does a license plate check by a law enforcement officer that reveals information about a person's car ownership, driver status and criminal record constitute a search under the Fourth Amendment? My daughter has problems. She is 13, beautiful, funny, smart, energetic, inquisitive, lonely, depressed and angry. She never really has had any friends and has complained of feeling invisible. When she finally found a friend, somebody who actually cared, she was a couple years older and moved onto high school and other interests. She didn't stop liking my daughter and has on several occasions tried to include her but most people sadly don't like my daughter. I hate it, but it is true.

When my daughter gets sad enough or mad enough or any other emotion enough that isn't getting her the attention she feels she deserves she had a very bad habit of lying to get sympathy. Usually in the form of a false sexual abuse allegation. She has done it four times so far, each against a different person and has always taken it back after about a week of getting the royal treatment from law enforcement and child services. She was taken from the home before and was always surrounded by people she knew and trusted. Well now she accused me. She was removed from the home and the investigation began. I use the word investigation very loosely because it was actually just the detective telling me I did it and really nothing else. After awhile of that conversation he came to my house and removed her bedspread and blanket to look for DNA and then they took her to the safe exam. That was last Thursday and I still am not arrested. Why? Because I am innocent. I tried on several occasions to talk to the detective and the child services worker that she has done this before and they need to look at her file. They say her past history of false accusations is irrelevant. I tried to explain to them that her older brother was there with me the whole time that she claims I molested her and that he will confirm my story but they say they don't need his testimony. He is 15 so I know he can testify. They separated her from her siblings and placed her in an undisclosed foster home because they know ( in my opinion ) that if they leave her with them they won't let her lie. THey have refused to ask my other kids about it because ( again, my opinion ) they know the truth and don't that to come out. They tried telling me that she is happy to be away from me and I am almost positive that they told her we dont love her but we have a friend whose kids go to her school and they say she is more depressed and scared than ever. I think its because she wants to come home. Why would her past be considered irrelevant? Why would her brothers testimony to confirm or deny her story not be important? Why do they refuse to even look at the evidence? Also the safe exam was last Friday. If they had found any physical evidence of any form of abuse, wouldn't they have already arrested me? I'd like to think that if they have the evidence they need to arrest a pedophile, that they'd get him or her off the streets immediately instead of letting them walk. Instead they have my daughter in a foster home and are buying her new clothes, music, coddling her and I am sure reminding her what to say. So why? to all my why's.

Without knowing all the facts, it would be ludicrous for an attorney to speculate about a law enforcement conspiracy. These type of investigations take time. Once the child is out of the house, the immediate threat is ameliorated. You should have had an initial hearing or team meeting by now. You should have learned more about the facts there. Based upon what you reported, the other parent should have access to your daughter soon, if your daughter wants to see her.

This alone does not give you the right to beak a lease. If you are interested in breaking your lease, you should consult a landlord-tenant attorney familiar with Chicago law. If you break your lease improperly, you could be liable for the rent for the remaining term of the lease.

Normally if you were to try to "break your lease" by moving out, even with notice, a single event like this would only be a defense to a later lawsuit by the landlord for unpaid rent under the lease. And in Chicago a single event reported by the tenant alone, without any corroboration, is not generally considered enough.

However, whether or not your apartment is covered by the Chicago Residential Landlord & Tenant Ordinance (RLTO), a relatively new Illinois State Law (Safe Homes Act) says that IF you are under threat of some kind of harm because of a domestic situation (and some other defined situations) and IF you can prove it, that CAN BE a defense to such a later lawsuit, and the RLTO seems to preserve this defense (RLTO Section 5-12-190).

However, again, it is a DEFENSE ONLY meaning unless your landlord is willing to let you out of your lease (or deal with the situation to your reasonable satisfaction) after notice, you still can be sued and whether the defense will work will be a question of the facts. You should see an attorney with ALL the facts you have, and have him or her help you make an appropriate decision.

You need to be careful on these things. There are lots of scammers out there who will tell you that you owe them money when you don't. Even if there was a legitimate debt, the person calling may not actually be representing the creditor, but has only learned about the debt through some other way, and any money you pay that person may not ever be credited against the account you owe.

Your message above does not say whether or not you ever actually borrowed any money from the pay day loan place mentioned above. If you never used their services, then you should ask them for their address so you can send them a letter disputing the debt and to tell them not to call you anymore.

You should also be aware that if this is a third party debt collector contacting you to collect upon the debt, threatening criminal prosecution is a violation of the FDCPA.

So the first question if whether the original agreement was properly modified. If he claims you "stole" the snowmobile then his option would be to file criminal charges. The police would have to do some investigating but if he signed the title over to you and advised you this was a gift, I don't think the police are going to do anything and they will tell the family member its a civil matter. The family member can sue you civilly for the loss of the snowmobile. In that case it would be up to you to defend any suits by claiming a gift. I have no idea what would happen - it depends on the quality of your proof versus the family member.

However, you have left a lot out of your post. People just don't give others snowmobiles and then change their mind. Either something happened between you or this was not really a gift and you were to just hold onto it. Or maybe there is some other explanation. Either way, there is a whole lot more to this story. I suggest that you refrain from posting anymore on the internet and have a consult with a local lawyer and acquaint him or her with the full details.

There is some misinformation about copyright and registration floating around the web, written by people who are not copyright lawyers and don't know the law. Your best source of information is the copyright office itself, which offers free online publications about the finer points of registration. To answer your questions:

Copyright attaches to a work when it is created, regardless of whether the work is registered. Registration is a legal means of claiming, and proving in court, that you created a work. Books written after 1978, in general, have only a single copyright date. An exception would be if the book is a collection of short works written at different times. Perhaps that is why you see multiple dates in a single book. Or, if the book was registered before 1978, a copyright renewal was required. That might also account for more than one copyright date. (If neither of those scenarios applies, it is likely that the person placing the copyright notice simply didn't know the law and wrongly supposed they were gaining some advantage.)

No, you can't extend the term of copyright by re-registering a work. My guess is that the support order in your case ordered that all payments were to be made through the State Disbursement Unit and that public aid had a claim for reimbursement for monies paid to your children's mother. Since you made these payments outside of the disbursement center, public aid has not gotten its money and likely will not unless your former mother-in-law is willing to pay over these funds to them through the State Disbursement Center. Lots of Luck on that. The courts supports what SS is saying.

Pro se legitimizations rarely go well. Ones where the state has intervened will go very badly without counsel, as you will be taking on not just the mother but the state. If your appendix burst would you remove it yourself to save money? Of course not. So why would you ruin your chance to get custody by not hiring someone who knows how to do it. Even if you have to borrow from friends and family, charge your fees on Mastercard, or mow every neighbors yard for extra cash, your child should matter enough to do it right. Get a lawyer.

If you have not been contacted by DFACS, you may want to find out who the caseworker is and contact him/her and let them know you are interested in filing to legitimate and obtaining custody. Hi there! When child support was initially calculated, it was done incorrectly while drawing up the divorce papers. The lawyer who was incorrect admitted that it was wrong as well.

But, then that lawyer said that the wrong amount could not be legally changed because the two parties agreed to it in an email themselves before this was even known.

Does this sound correct? Can this happen? Thank you!

Sure it can. While the state has child support guidelines, the parties can agree on a different number, and, if they do, that number becomes the number if the court agrees.

Our neighbor routinely calls the police on us, calls the town on us, has listed our property for sale, and screams at us any time we are out in our yard. The police have found no truth to her allegations....61 so far. We were asked by the police to do a mediation, and it ended in the neighbors storming out vowing to get an attorney after I suggested we all just sit down over a cup of coffee and discuss it without wasting law enforcement time. The police have done nothing to stop her behavior. It has been going on for over a year. What do we do since the police do not want to be involved?

I am sorry for the problems. If the police will not pursue this as a criminal issue then your only option is for a civil lawsuit for various claims. This, however, may just make things worse. I would still try other attempts to resolve this civilly (maybe through the church or city mediation avenues) and if that goes nowhere and they continue with their actions then file suit. You could get a protective order and other remedies that could stop this.

Good luck and, obviously, speak with an attorney if they do file suit and for your claims if civil settlement goes nowhere.

am I required to file a will into probate if all assets were beneficiaried? My father passed away 6 months ago and I didn't think it had to be filed. Everything was left to me. The only thing not beneficiaried were the contents of his home. I live in Fl.

Also my brother is deaf and signed over his rights to my fathers house to me 2 months before my father passed. These were my fathers wishes and done before he died. His nosey neighbor contacted an attorney who now says his rights were violated because he had no interpreter. Is this the case even though we were in a law office and he indicated he understood what he was signing?

My father had left my brother some cash and changed his mind in 2012 and changed it because of his fear of him blowing it. His nosey neighbor went through my fathers papers without my knowledge and came across an OLD form prior to the change. All life insurance and banking has been transfered to me already per his beneficiary forms he filed. Do i need to do anything more?

There were also 2 checking accounts that were joint between my father and I PRIOR to his death. I used some of these funds prior to his death to pay his bills and my own. Are these accounts considered estate property if they were joint?

Go to an attorney and review all your documents. If no assets were owned by decedent then no need to probate an Estate. Beneficiaried makes it sound like the Will is actually making the distributions. If that is the case a Probate is needed. Your nosey neighbor cannot change the plan that your father laid out. The title on the accounts matters to determine if they passed to you on his death. Again, seek legal help to make sure you are handling this all correctly. Sorry about your loss.

She's a "gratuitous guest" who technically doesn't have the rights of a tenant. However, as a practical matter, if the property owner sues her for eviction after the 30 days have lapsed, then she'll probably get some time from the judge to move out, if only because she's a disabled old woman. There are also other factors as well - if the home is title in the name of the dead partner's parents, and if they are themselves deceased, then no one can file for eviction unless an executor or administrator is appointed by the Probate Court.
